Drafting For Litigators

Intended audience:

3 hours

Small group workshop, including practical case study exercises, discussion and feedback

The objectives of this course are to:

  • Provide trainees with a basic understanding of the principles of good draftsmanship
  • Show how the overriding objective is achieved in terms of the rules on pleadings contained in the Civil Procedure Rules (CPR)
  • Allow trainees to gain confidence in their ability to draft pleadings through exercises focused on statements of case and further information


  • Introduction: impact of the CPR on the approach to pleadings
  • The ingredients of good drafting
  • Pre-action protocols and letters of claim
  • Statements of case
  • Drafting particulars of claim
  • The defence
  • Further information

The success measures for the course are that trainees:

  • Appreciate what is required to ensure compliance with the requirements of pre-action protocols / the Protocols Practice Direction
  • Are able to draft their own particulars of claim, defence and requests for further information (and replies thereto), and evaluate drafts prepared by others, e.g. counsel
